Terms

Transparent (transparentrent.com) is run by Instance, LLC (“we,” “us”). By using Transparent or creating an account, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use Transparent.

What Transparent is

Transparent shows asking rents and how they change, using data from publicly available listing sources. It is for information only. It isn’t legal, financial or housing advice. We aren’t a landlord, broker or agent. Listings and prices may be wrong, out of date or no longer available, so confirm the details with the property before you decide anything.

Who can use it

You must be at least 18 and using Transparent in the United States. The information you give us must be accurate. You’re responsible for your account and for keeping access to your email secure.

Using Transparent fairly

You agree not to:

• scrape, copy in bulk, or resell data or content from Transparent;
• get around the bot check or other security, or interfere with how the site runs;
• use Transparent for anything unlawful or harmful.

We may suspend or close an account that breaks these Terms.

Emails

We’ll send the emails you ask for (sign-in codes and price alerts), notices about your account or these Terms, and occasional updates about Transparent. Every alert and update has a link to unsubscribe or pause.

Paid features

Transparent is free today. If we add paid features, we’ll show the price and terms before you pay, and a third-party payment processor will handle payments.

Content and feedback

The site’s design, charts, text and the way we compile listing data belong to Instance, LLC. We don’t claim to own the underlying facts from listing sources. If you send us feedback or ideas, we may use them without owing you anything.

Changes to the service

We may change, pause or stop any part of Transparent at any time.

No warranties

Transparent is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the site will be uninterrupted, secure or error-free.

Limits on our liability

To the fullest extent the law allows, Instance, LLC and its owners, employees and agents aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or housing opportunities, arising from your use of Transparent. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or $50.

You agree to cover any claims, losses and costs (including reasonable legal fees) that arise from your misuse of Transparent or your breaking these Terms.

Disputes

• Talk to us first. Email info@transparentrent.com and give us 30 days to try to sort it out.
• Arbitration. If we can’t resolve it, the dispute goes to binding individual arbitration with the American Arbitration Association under its Consumer Arbitration Rules. The arbitration is held by video or phone, or in the county where you live.
• Exceptions. Either of us may bring a claim in small claims court instead. Either of us may also go to court to stop misuse of Transparent or of intellectual property.
• No class actions. Disputes are brought individually, not as part of a class, collective or representative action.
• Law. Oregon law governs these Terms. Any court case that isn’t arbitrated goes to the state or federal courts in Oregon, unless the law where you live says otherwise.

Changes to these Terms

When we change these Terms, we’ll post the new version here with a new effective date. If a change is significant, we’ll also email people who have an account. Using Transparent after a change means you accept the new Terms.

Everything else

These Terms and our Privacy Policy are the whole agreement between you and us about Transparent. If part of these Terms can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t given up the right to enforce it. We may transfer these Terms as part of a merger, acquisition or sale of our business.
